The plaintiff in error Alfred J. Pillsbury (hereinafter called "defendant") was convicted on his pleas of guilty of burglary in violation of sec. 943.10 (1), Stats., of possession of burglarous tools in violation of sec. 943.12, and of perjury in violation of sec. 946.31. He was sentenced to the state prison at Waupun for concurrent indeterminate terms not exceeding ten years for burglary, five years for the possession of burglarous tools, and two years for perjury. The defendant being an indigent, counsel was appointed by this court to prosecute this writ of error, which raises the questions of whether in the prosecution for a felony a warrant of arrest must be issued and served before bringing the accused before a magistrate for a preliminary hearing on the complaint and whether a prosecution for a felony may be commenced by an information when a proper complaint has not been made.
